The UA Sheepshead Bay theater, TGI Friday’s, Knapp Street Bagels and the Deauville Marina released untreated sewage containing toilet paper and fecal matter into Shell Bank Creek, which flows into Jamaica Bay and eventually the Atlantic Ocean, DA Charles Hynes said.
The area is not served by city sewer lines and the businesses failed to repair private wastewater lines despite several warnings from city officials, Hynes said.
"There is no excuse for the disgraceful pollution of our waterways and beaches," Hynes said.
"[This is] a sustained pattern of individual and corporate misconduct dating back to 2003.
Deauville Marina maintained an outhouse that dumped directly into the creek, Hynes said.
The bagel shop and TGI Friday’s also dumped untreated waste grease and oil into the waterway, the DA said.

Pink Ribbon Bagels: A Life-saving effort
During October, Breast Cancer Awareness Month, Panera Bread restaurants in the Tulsa area are selling Pink Ribbon Bagels. Sue Stees, one of the owners of Panera Bread, came up with the idea.
"I'm a 26 year survivor," said Sue Stees. "If I had heard that terrifying news and then couldn't afford to pay for any treatment that would have been devastating. We want to raise money for Tulsa Project Woman so more women and men in our community can get treatment if they need it."
This is the tenth year Stees' bakery-cafes are offering the Pink Ribbon Bagels. On October 1, "Go Pink at Panera" day, all of the proceeds from the Pink Ribbon Bagels will go directly to Tulsa Project Woman, a non-profit agency that provides breast health education, no cost mammography, diagnostic procedures and surgical services for women in need.

In New York, the sale of whole bagels isn't subject to sales tax. But the tax does apply to "sliced or prepared bagels (with cream cheese or other toppings)," according to the state Department of Taxation and Finance. And if the bagel is eaten in the store, even if it's never been touched by a knife, it's also taxable.
That was news to one New York bagel-store owner, who found out he was out of compliance with the policy this summer when the state audited his company.
Kenneth Greene, the owner of 33 Bruegger's Bagel franchises throughout New York, says the state demanded that he start charging taxes on all bagels, except for those that remain intact and are consumed off premises, and forced him to pay a "significant" sum in taxes that the state estimated he owed.
Mr. Greene says the extra charge, about eight cents a bagel, depending on the local rate, filled his customers with boiling rage. "They felt we were nickel-and-diming them. They thought we were charging them to slice a bagel," he said.
Larry King is bringing bagels to Beverly Hills
We know what's next for Piers Morgan, he'll replace Larry King on CNN next year. But what's next for Larry King? He's going into the bagel business.
The talk show giant plans to open the first West Coast outpost of the Original Brooklyn Water Bagel Co. in Beverly Hills in November. The restaurant, which will use "Brooklynized" water but plans to feature California cuisine, will be located at 262 Beverly Drive and will capitalize on all things Larry King. King also has signed on to be the company's national spokesman and its West Coast developer.
The 3,700-square-foot location can seat up to 70 people inside and 24 people on its patio. It will also be outfitted with a special Larry King booth, which can seat eight and is reserved specifically for King and his guests. At its center will be a Larry King-style microphone. I bet it the booth will also look extremely serious, wear suspenders and have big glasses (for water).

H&H Bagels Owner Going To Jail
H&H Bagels Owner Helmer Toro Gets 50 Weekends in Jail for Grand Larceny - Bloomberg.com
The owner of H&H Bagels, a bagel store on New York City’s Upper West Side, was sentenced to 50 weekends in jail after failing to pay more than $500,000 in employee withholding and unemployment insurance taxes.
“The court will impose the promised sentence,” New York state judge Juan M. Merchan told H&H Bagels’ Helmer Toro in his lower Manhattan courtroom today. The judge also ordered restitution.
Toro, 59, failed to turn over $337,261 withheld from the paychecks of employees at his bagel business from 2003 to 2009, according to his May plea agreement. Toro also evaded $206,151 in unemployment-insurance taxes between 2006 and 2009. As part of the agreement, Toro must make the restitution totaling $543,413.
H&H Bagels, called “legendary” by the travel guide Fodor’s, is located on Broadway near 80th Street. The retailer and wholesaler’s flagship baking location is on West 46th Street near 12th Avenue. Its tagline is “Like no other bagel in the world.”

Scooped Bagels Article
The New York bagel isn't dying -- it's just wounded.
Carb-counting New Yorkers -- who want to diet but can't bear to give up their bagels and shmear -- are demanding the soft guts of their doughy circles professionally removed, leaving behind only a crusty carcass to nosh on.
It's called "scooped out," and it's the disfigured version of the Jewish delicacy that is quickly becoming the norm among New Yorkers -- and driving bagel purists and purveyors bonkers.
